There was a time in our country when each state had its own legislative powers to decide the legislation on gaming in their state. It was their own choice and vision to make the gambling legalized or banned. But now after the Febral Public Gambling Act 1867 there has been proper differentiation has been made between:-

• Game of skill
• Game of chance

And a proper legislation has been made that game of skill will be a part of gaming whereas game of chance will be considered as gambling and will be considered unlawful in our country “India ''. Therefore, all types of gaming weather online or offline but which put following things such as:-

• Game of chance
• Involves money or any asset which can be valued at monetary value.
• Involves betting and wagering of money or stake.

All of the above mentioned things are strictly unlawful in India.

Whereas this act does not violate any of the gaming which involves skill for playing.

Conclusion:-

All the people who love gambling can play games if the type of gaming in which gambling involves also have gaming skills then this can not outright the law and can be considered legal.

Although:-

• Putting money on cricket which the one is not even playing is not legal and considered as unlawful which leads to punishment in Indian law.
• Putting money on lotteries and horse betting is considered legal in our country.

This means that there is no basic substantial law which differentiate gaming of skills and gaming of chance.

Therefore, we can say online gaming which involves gambling is legal in India as there is no defined law or provision which explicitly works on this and says it is unlawful as all the justification and laws with respect to it is unclear which gives an image that online gambling is legal and one can not get arrested for the same.
